*Obedience to the injunctions of the Glorious Qur’aan and the dictates of the Sunnah in all matters of the state as enunciated in the following Ayaat.
The Holy Qur'an Sura: 3. Al.'Imran Verse: 32 Juz: 3 Revealed: Madinah
Muhsin Khan Say (O Muhammad SAW): "Obey Allah and the Messenger (Muhammad SAW)." But if they turn away, then Allah does not like the disbelievers.
Transliteration QUL AT.EcO 'ALLAAH WA- AR- RASOL FA- 'IN TAWALLAW FA- 'INNA 'ALLAAH LAA YUH.IBB AL- KAAFIREN
The Holy Qur'an Sura: 3. Al.'Imran Verse: 132 Juz: 4 Revealed: Madinah
Muhsin Khan And obey Allah and the Messenger (Muhammad SAW) that you may obtain mercy.
Transliteration WA- AT.EcO 'ALLAAH WA- AR- RASOL LAcALLA -KUM TURH.AMON
The Holy Qur'an Sura: 5. Maa'idah Verse: 92 Juz: 7 Revealed: Madinah
Muhsin Khan And obey Allah and the Messenger (Muhammad SAW), and beware (of even coming near to drinking or gambling or AlAnsab, or AlAzlam, etc.) and fear Allah. Then if you turn away, you should know that it is Our Messenger's duty to convey (the Message) in the clearest way.
Transliteration WA- AT.EcO 'ALLAAH WA- AT.EcO AR- RASOL WA- IH.DHARO FA- 'IN TAWALLAYTUM FA- IcLAMO 'ANNA-MAA cALAA RASOL -NAA AL- BALAAGH AL- MUBEN
The Holy Qur'an Sura: 8. Anfaal Verse: 46 Juz: 10 Revealed: Madinah
Muhsin Khan And obey Allah and His Messenger, and do not dispute (with one another) lest you lose courage and your strength depart, and be patient. Surely, Allah is with those who are As-Sabirin (the patient ones, etc.).

The Holy Qur'an Sura: 24. Noor Verse: 54 Juz: 18 Revealed: Madinah
Muhsin Khan Say: "Obey Allah and obey the Messenger, but if you turn away, he (Messenger Muhammad SAW) is only responsible for the duty placed on him (i.e. to convey Allah's Message) and you for that placed on you. If you obey him, you shall be on the right guidance. The Messenger's duty is only to convey (the message) in a clear way (i.e. to preach in a plain way)."

The Holy Qur'an Sura: 47. Muhammed Verse: 33 Juz: 26 Revealed: Madinah
Muhsin Khan O you who believe! Obey Allah, and obey the Messenger (Muhammad SAW) and render not vain your deeds.

The Holy Qur'an Sura: 64. Taghaabun Verse: 12 Juz: 28 Revealed: Madinah
Muhsin Khan Obey Allah, and obey the Messenger (Muhammad SAW), but if you turn away, then the duty of Our Messenger is only to convey (the Message) clearly.

**Establishment of the rule of Shariah in the land by the head of the Islaamic state as enunciated in the following Ayaat.
The Holy Qur'an Sura: 22. Hajj Verse: 41 Juz: 17 Revealed: Madinah
Muhsin Khan Those (Muslim rulers) who, if We give them power in the land, (they) order for Iqamat-as-Salat. [i.e. to perform the five compulsory congregational Salat (prayers) (the males in mosques)], to pay the Zakat and they enjoin Al-Ma'ruf (i.e. Islamic Monotheism and all that Islam orders one to do), and forbid Al-Munkar (i.e. disbelief, polytheism and all that Islam has forbidden) [i.e. they make the Qur'an as the law of their country in all the spheres of life]. And with Allah rests the end of (all) matters (of creatures).
Transliteration 'ALLADHENA 'IN MAKKANNAA -HUM FE AL- 'ARD. AQAAMO AS.- S.ALAAH WA- 'AATAW AZ- ZAKAAH WA- 'AMARO BI- AL- MAcROF WA- NAHAW cAN AL- MUNKAR WA- LI- 'ALLAAH cAAQIBAH AL- 'UMOR
The Holy Qur'an Sura: 24. Noor Verse: 55 Juz: 18 Revealed: Madinah
Muhsin Khan Allah has promised those among you who believe, and do righteous good deeds, that He will certainly grant them succession to (the present rulers) in the earth, as He granted it to those before them, and that He will grant them the authority to practice their religion, that which He has chosen for them (i.e. Islam). And He will surely give them in exchange a safe security after their fear (provided) they (believers) worship Me and do not associate anything (in worship) with Me. But whoever disbelieved after this, they are the Fasiqun (rebellious, disobedient to Allah).
Transliteration WAcADA 'ALLAAH 'ALLADHENA 'AAMANO MIN -KUM WA- cAMILO AS.- S.AALIH.AAT LA- YASTAKHLIFANNA -HUM FE AL- 'ARD. KA-MAA ISTAKHLAFA 'ALLADHENA MIN QABLI -HIM WA- LA- YUMAKKINANNA LA- -HUM DEN -HUM 'ALLADHE IRTAD.AA LA- -HUM WA- LA- YUBADDILANNA -HUM MIN BAcDI KHAWF -HIM 'AMN(AN) YAcBUDON -NE LAA YUSHRIKON BI- -Y SHAY'(AN) WA- MAN KAFARA BAcDA DHAALIKA FA- 'OLAA'IKA HUM AL- FAASIQON
***Authority for the appointment or dismissal of the Head of Islaamic state is vested in the Muslim Ummah.
The Ayaat 3:159' 42:38 quoted below emphasize the importance of consultation among the Muslims for every activity of their lives ranging from the family to the state. Thus, it is imperative for the Muslims to have mutual consultation for all collective affairs of their lives. Hence their ruler who holds the highest trust on their behalf, should be chosen by the after due consultation as the worthiest person among them, and he while supervising their affairs should administer this trust with the utmost justice, as enunciated in the following Ayah.
The Holy Qur'an Sura: 4. Nisaa Verse: 58 Juz: 5 Revealed: Madinah
Muhsin Khan Verily! Allah commands that you should render back the trusts to those, to whom they are due; and that when you judge between men, you judge with justice. Verily, how excellent is the teaching, which He (Allah) gives you! Truly, Allah is Ever AllHearer, AllSeer.
Transliteration 'INNA 'ALLAAH YA'MUR -KUM 'AN TU'ADDO AL- 'AMAANAAT 'ILAA 'AHL -HAA WA- 'IDHAA H.AKAMTUM BAYNA AN- NAAS 'AN TAH.KUMO BI- AL- cADL 'INNA 'ALLAAH NIcIM MAA YAcIZ. -KUM BI- -HI 'INNA 'ALLAAH KAANA SAMEc(AN) BAS.ER(AN)
***Consultation on the part of the Head of the Islaamic state with Ummah in all fundamental matters as enunciated in the following Ayaat.
The Holy Qur'an Sura: 3. Al.'Imran Verse: 159 Juz: 4 Revealed: Madinah
Muhsin Khan And by the Mercy of Allah, you dealt with them gently. And had you been severe and harsh hearted, they would have broken away from about you; so pass over (their faults), and ask (Allah's) Forgiveness for them; and consult them in the affairs. Then when you have taken a decision, put your trust in Allah, certainly, Allah loves those who put their trust (in Him).
Transliteration FA- BI- MAA RAH.MAH MIN 'ALLAAH LINTA LA- -HUM WA- LAW KUNTA FAZ.Z.(AN) GHALEZ. AL- QALB LA- INFAD.D.O MIN H.AWL -KA FA- UcFU cAN -HUM WA- ISTAGHFIR LA- -HUM WA- SHAAWIR -HUM FE AL- 'AMR FA- 'IDHAA cAZAMTA FA- TAWAKKAL cALAA 'ALLAAH 'INNA 'ALLAAH YUH.IBB AL- MUTAWAKKILEN
The Holy Qur'an Sura: 42. Shura Verse: 38 Juz: 25 Revealed: Makkah
Muhsin Khan And those who answer the Call of their Lord [i.e. to believe that He is the only One Lord (Allah), and to worship none but Him Alone], and perform As-Salat (Iqamat-as-Salat), and who (conduct) their affairs by mutual consultation, and who spend of what We have bestowed on them;
Transliteration WA- 'ALLADHENA ISTAJAABO LI- RABB -HIM WA- AQAAMO AS.- S.ALAAH WA- 'AMR -HUM SHORAA BAYNA -HUM WA- MIN MAA RAZAQNAA -HUM YUNFIQON
*****Obedience on the part of the citizens of an Islaamic state to the lawful orders of the authorities is based on the following Ayaat.
The Holy Qur'an Sura: 4. Nisaa Verse: 59 Juz: 5 Revealed: Madinah
Muhsin Khan O you who believe! Obey Allah and obey the Messenger (Muhammad SAW), and those of you (Muslims) who are in authority. (And) if you differ in anything amongst yourselves, refer it to Allah and His Messenger (SAW), if you believe in Allah and in the Last Day. That is better and more suitable for final determination.
Transliteration YAA 'AYYUHAA 'ALLADHENA 'AAMANO AT.EcO 'ALLAAH WA- AT.EcO AR- RASOL WA- 'OLE AL- 'AMR MIN -KUM FA- 'IN TANAAZAcTUM FE SHAY' FA- RUDDO -HU 'ILAA 'ALLAAH WA- AR- RASOL 'IN KUNTUM TU'MINON BI- 'ALLAAH WA- AL- YAWM AL- 'AAKHIR DHAALIKA KHAYR WA- AH.SAN TA'WEL(AN)
The Holy Qur'an Sura: 4. Nisaa Verse: 83 Juz: 5 Revealed: Madinah
Muhsin Khan When there comes to them some matter touching (public) safety or fear, they make it known (among the people), if only they had referred it to the Messenger or to those charged with authority among them, the proper investigators would have understood it from them (directly). Had it not been for the Grace and Mercy of Allah upon you, you would have followed Shaitan (Satan), save a few of you.
Transliteration WA- 'IDHAA JAA'A -HUM 'AMR MIN AL- 'AMN 'AW AL- KHAWF ADHAAcO BI- -HI WA- LAW RADDO -HU 'ILAA AR- RASOL WA- 'ILAA 'OLE AL- 'AMR MIN -HUM LA- cALIMA -HU 'ALLADHENA YASTANBIT.ON -HU MIN -HUM WA- LAW-LAA FAD.L 'ALLAAH cALAY -KUM WA- RAH.MAH -HU LA- ITTABAcTUM ASH- SHAYT.AAN 'ILLAA QALEL(AN)
******Justice should prevail in all walks of life in an Islaamic state; otherwise it would be Islaamic state only in name and not in fact, as defined below.
Justice should be done by the means of Glorious Qur’aan (see 4:105); Believers should be maintainers of justice (see 4:48, 4:135); Allaah has enjoined justice (see 5:42, 7:29, 16:90); Allaah loves the just (see (5:42, 49:9, 60:8); Believers should make peace between two quarreling parties of them with justice (49:9); All Messengers conveyed to mankind to uphold justice (see 57:25); Disbelievers who do not fight the Believers on account of religion, should be dealt with kindness and justice (see 60:8); Testimony should be taken from persons of equity (see 5:106); Those who do not judge by what Allaah has revealed they are disbelievers (see 5:44), are evildoers (see 5:45), are transgressors (see 5:47).
*******Punishment for subversion against an Islaamic state ranges from banishment from the country to the death by hanging according to the intensity of the crime as enunciated in the following Ayah.
The Holy Qur'an Sura: 5. Maa'idah Verse: 33 Juz: 6 Revealed: Madinah
Muhsin Khan The recompense of those who wage war against Allah and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off on the opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter.
Transliteration 'INNA-MAA JAZAA' 'ALLADHENA YUH.AARIBON 'ALLAAH WA- RASOL -HU WA- YAScAWN FE AL- 'ARD. FASAAD(AN) 'AN YUQATTALO 'AW YUS.ALLABO 'AW TUQAT.T.Ac AYDE -HUM WA- ARJUL -HUM MIN KHILAAF 'AW YUNFAW MIN AL- 'ARD. DHAALIKA LA- -HUM KHIZY FE AD- DUNYAA WA- LA- -HUM FE AL- 'AAKHIRAH cADHAAB cAZ.EM
THE PRINCIPLE OF LEGISLATION IN ISLAAM IS BASED ON THE FOLLOWING FOUR FUNDAMENTALS.
(I) Glorious Qur’aan, as explained in the following Ayaat!
The Holy Qur'an Sura: 5. Maa'idah Verse: 48 Juz: 6 Revealed: Madinah
Muhsin Khan And We have sent down to you (O Muhammad SAW) the Book (this Qur'an) in truth, confirming the Scripture that came before it and Mohayminan (trustworthy in highness and a witness) over it (old Scriptures). So judge between them by what Allah has revealed, and follow not their vain desires, diverging away from the truth that has come to you. To each among you, We have prescribed a law and a clear way. If Allah willed, He would have made you one nation, but that (He) may test you in what He has given you; so strive as in a race in good deeds. The return of you (all) is to Allah; then He will inform you about that in which you used to differ.
Transliteration WA- ANZALNAA 'ILAY -KA AL- KITAAB BI- AL- H.AQQ MUS.ADDIQ(AN) LI- MAA BAYNA YADAI -HI MIN AL- KITAAB WA- MUHAYMIN(AN) cALAY -HI FA- UH.KUM BAYNA -HUM BI- MAA ANZALA 'ALLAAH WA- LAA TATTABIc AHWAA' -HUM cAN MAA JAA'A -KA MIN AL- H.AQQ LI- KULL JAcALNAA MIN -KUM SHIRcAH WA- MINHAAJ(AN) WA- LAW SHAA'A 'ALLAAH LA- JAcALA -KUM 'UMMAH WAAH.IDAH WA- LAAKIN LI- YABLUWA -KUM FE MAA 'AATAA -KUM FA- ISTABIQO AL- KHAYRAAT 'ILAA 'ALLAAH MARJIc -KUM JAMEc(AN) FA- YUNABBI' -KUM BI- MAA KUNTUM FE -HI TAKHTALIFON
The Holy Qur'an Sura: 5. Maa'idah Verse: 49 Juz: 6 Revealed: Madinah
Muhsin Khan . And so judge (you O Muhammad SAW) between them by what Allah has revealed and follow not their vain desires, but beware of them lest they turn you (O Muhammad SAW) far away from some of that which Allah has sent down to you. And if they turn away, then know that Allah's Will is to punish them for some sins of theirs. And truly, most of men are Fasiqun (rebellious and disobedient to Allah).

MAA ANZALA 'ALLAAH 'ILAY -KA FA- 'IN TAWALLAW FA- IcLAM 'ANNA-MAA YURED 'ALLAAH 'AN YUS.EB -HUM BI- BAcD. DHUNOB -HIM WA- 'INNA KATHER(AN) MIN AN- NAAS LA- FAASIQON
The Holy Qur'an Sura: 5. Maa'idah Verse: 50 Juz: 6 Revealed: Madinah
Muhsin Khan Do they then seek the judgment of (the Days of) Ignorance? And who is better in judgment than Allah for a people who have firm Faith.

The Holy Qur'an Sura: 6. An'aam Verse: 114 Juz: 8 Revealed: Makkah
Muhsin Khan [Say (O Muhammad SAW)] "Shall I seek a judge other than Allah while it is He Who has sent down unto you the Book (The Qur'an), explained in detail." Those unto whom We gave the Scripture [the Taurat (Torah) and the Injeel (Gospel)] know that it is revealed from your Lord in truth. So be not you of those who doubt.
Transliteration 'A- FA- GHAYR 'ALLAAH ABTAGHE H.AKAM(AN) WA- HUWA 'ALLADHE ANZALA 'ILAY -KUM AL- KITAAB MUFAS.S.AL(AN) WA- 'ALLADHENA 'AATAYNAA -HUM AL- KITAAB YAcLAMON 'ANNA -HU MUNAZZAL MIN RABB -KA BI- AL- H.AQQ FA- LAA TAKONANNA MIN AL- MUMTAREN
The Holy Qur'an Sura: 6. An'aam Verse: 115 Juz: 8 Revealed: Makkah
Muhsin Khan And the Word of your Lord has been fulfilled in truth and in justice. None can change His Words. And He is the AllHearer, the AllKnower.
Transliteration WA- TAMMAT KALIMAH RABB -KA S.IDQ(AN) WA- cADL(AN) LAA MUBADDIL LI- KALIMAAT -HI WA- HUWA AS- SAMEc AL- cALEM
The Holy Qur'an Sura: 6. An'aam Verse: 116 Juz: 8 Revealed: Makkah
Muhsin Khan And if you obey most of those on earth, they will mislead you far away from Allah's Path. They follow nothing but conjectures, and they do nothing but lie.

The Holy Qur'an Sura: 7. Al-Araaf Verse: 2 Juz: 8 Revealed: Makkah
Muhsin Khan (This is the) Book (the Qur'an) sent down unto you (O Muhammad SAW), so let not your breast be narrow there from, that you warn thereby, and a reminder unto the believers.
Transliteration KITAAB UNZILA 'ILAY -KA FA- LAA YAKUN FE S.ADR -KA H.ARAJ MIN -HU LI- TUNDHIR BI- -HI WA- DHIKRAA LI- AL- MU'MINEN
The Holy Qur'an Sura: 7. Al-Araaf Verse: 3 Juz: 8 Revealed: Makkah
Muhsin Khan [Say (O Muhammad SAW) to these idolaters (pagan Arabs) of your folk:] Follow what has been sent down unto you from your Lord (the Qur'an and Prophet Muhammad's Sunnah), and follow not any Auliya' (protectors and helpers, etc. who order you to associate partners in worship with Allah), besides Him (Allah). Little do you remember!
Transliteration ITTABIcO MAA UNZILA 'ILAY -KUM MIN RABB -KUM WA- LAA TATTABIcO MIN DONI -HI AWLIYAA' QALEL(AN) MAA TADHAKKARON
The Holy Qur'an Sura: 39. Zumar Verse: 55 Juz: 24 Revealed: Makkah
Muhsin Khan "And follow the best of that which is sent down to you from your Lord (i.e. this Qur'an, do what it orders you to do and keep away from what it forbids), before the torment comes on you suddenly while you perceive not!"

Muhsin Khan We sent no Messenger, but to be obeyed by Allah's Leave. If they (hypocrites), when they had been unjust to themselves, had come to you (Muhammad SAW) and begged Allah's Forgiveness, and the Messenger had begged forgiveness for them: indeed, they would have found Allah All-Forgiving (One Who accepts repentance), Most Merciful.

The Holy Qur'an Sura: 4. Nisaa Verse: 80 Juz: 5 Revealed: Madinah
Muhsin Khan He who obeys the Messenger (Muhammad SAW) has indeed obeyed Allah, but he who turns away, then we have not sent you (O Muhammad SAW) as a watcher over them.
Transliteration MAN YUT.Ic AR- RASOL FA- QAD AT.AAcA 'ALLAAH WA- MAN TAWALLAA FA- MAA ARSALNAA -KA cALAY -HIM H.AFEZ.(AN)
The Holy Qur'an Sura: 8. Anfaal Verse: 24 Juz: 9 Revealed: Madinah
Muhsin Khan O you who believe! Answer Allah (by obeying Him) and (His) Messenger when he (SAW) calls you to that which will give you life, and know that Allah comes in between a person and his heart (i.e. He prevents an evil person to decide anything). And verily to Him you shall (all) be gathered.
Transliteration YAA 'AYYUHAA 'ALLADHENA 'AAMANO ISTAJEBO LI- 'ALLAAH WA- LI- AR- RASOL 'IDHAA DAcAA -KUM LI- MAA YUH.YE -KUM WA- IcLAMO 'ANNA 'ALLAAH YAH.OL BAYNA AL- MAR' WA- QALB -HI WA- 'ANNA -HU 'ILAY -HI TUH.SHARON
The Holy Qur'an Sura: 24. Noor Verse: 56 Juz: 18 Revealed: Madinah
Muhsin Khan And perform AsSalat (IqamatasSalat), and give Zakat and obey the Messenger (Muhammad SAW) that you may receive mercy (from Allah).
Transliteration WA- AQEMO AS.- S.ALAAH WA- 'AATO AZ- ZAKAAH WA- AT.EcO AR- RASOL LAcALLA -KUM TURH.AMON
The Holy Qur'an Sura: 60. Mumtahana Verse: 6 Juz: 28 Revealed: Madinah
Muhsin Khan Certainly, there has been in them an excellent example for you to follow, for those who look forward to (the Meeting with) Allah (for the reward from Him) and the Last Day. And whosoever turn away, then verily, Allah is Rich (Free of all wants), Worthy of all Praise.
Transliteration LA- QAD KAANA LA- -KUM FE -HIM 'USWAH H.ASANAH LI- MAN KAANA YARJO 'ALLAAH WA- AL- YAWM AL- 'AAKHIR WA- MAN YATAWALLA FA- 'INNA 'ALLAAH HUWA AL- GHANEY AL- H.AMED
(III) The Ijmaa or consensus of the Ummah based on the opinion of the Companions of the Prophet Muhammad (SAW) as enunciated in the following Ayah.
The Holy Qur'an Sura: 9. Taubah Verse: 100 Juz: 11 Revealed: Madinah
Muhsin Khan And the first to embrace Islam of the Muhajirun (those who migrated from Makkah to Al-Madinah) and the Ansar (the citizens of Al-Madinah who helped and gave aid to the Muhajirun) and also those who followed them exactly (in Faith). Allah is well-pleased with them as they are well-pleased with Him. He has prepared for them Gardens under which rivers flow (Paradise), to dwell therein forever. That is the supreme success.
Transliteration WA- AS- SAABIQON AL- 'AWWALON MIN AL- MUHAAJIREN WA- AL- ANS.AAR WA- 'ALLADHENA ITTABAcO -HUM BI- IH.SAAN RAD.IYA 'ALLAAH cAN -HUM WA- RAD.O cAN -HU WA- AcADDA LA- -HUM JANNAAT TAJRE TAH.TA -HAA AL- ANHAAR KHAALIDEN FE -HAA 'ABAD(AN) DHAALIKA AL- FAWZ AL- cAZ.EM
(IV) Ijtihaad (Ijtihad) or independent judgment, based on Glorious Qur’aan and Sunnah, of the leaders of Ummah in matters of Judiciary, politics, administration and war as enunciated in the following Ayaat.
